New Jersey Consumer Fraud Act

Despite existing consumer protection laws designed to prevent deceptive practices, consumer fraud persists, including false advertising, overcharging, undisclosed fees, and other dishonest tactics. Every state has enacted a Consumer Fraud or Unfair Trade Practices Act, with the New Jersey Consumer Fraud Act standing out as one of the nation’s most robust.


Our attorneys, specializing in consumer rights, are well-versed in the New Jersey Consumer Fraud Act and have successfully represented numerous clients in fraud cases. Originally intended for the Attorney General’s use, the Act was amended in 1971 to empower private citizens, allowing law firms like South Jersey Law Center to pursue lawsuits on behalf of individuals wronged by businesses. This amendment expanded remedies to include treble damages (triple) and the recovery of attorneys’ fees and costs.


The New Jersey Consumer Fraud Act serves three primary purposes: 1) compensating victims for actual losses, 2) penalizing sellers through treble damages, and 3) attracting competent counsel to combat fraud by providing incentives for attorneys to take cases involving minor losses. Liberally construed in favor of consumers, the law discourages bad behavior and protects unsuspecting consumers, resulting in significant consumer protection from New Jersey Courts.
